1. About HOPE and these terms
This website, hope-ivf.com, is operated by Hope Fertility Clinic Ltd, registered in Malta under company registration number C-100161, trading as HOPE Fertility & IVF Clinic (“HOPE”, “we”, “us” or “our”).
Our clinic is located at The Watercourse Building, Level 2, Triq L-Esportaturi, Zone 2, Central Business District, CBD 2010, Birkirkara, Malta.

These terms explain the permitted use of our website and the general conditions for enquiries and arranging services. Please read them before using our online services.
Medical treatment, cryopreservation and participation in specific programmes require separate agreements and informed consent. These website terms do not themselves create a treatment agreement. If a specific service agreement differs from these general terms, the specific agreement applies to that service, subject to applicable law and your mandatory rights.
2. Website information and medical advice
Our website provides general information about fertility, treatments and clinic services. It does not provide a diagnosis or replace an individual consultation with a qualified healthcare professional.
Do not start, stop or change medication or treatment based solely on website content. Suitability, risks, alternatives and the proposed treatment plan must be discussed with your treating team.
We aim to keep information accurate and current. If you notice an error or need clarification, please contact us. Website enquiries and messages are not an emergency service. In a medical emergency, call 112 or seek urgent medical assistance.
3. Treatment eligibility and outcomes
Treatment is subject to individual medical assessment, informed consent, applicable Maltese law and any required regulatory approval. Enquiries, appointment requests and payments do not by themselves establish eligibility or authorise treatment.
Please provide accurate and complete medical, identity and contact information, and tell us promptly about relevant changes. Where residency or public funding eligibility is relevant, supporting documents may be required before treatment can proceed.
Fertility outcomes vary between individuals. Published success rates describe results for defined patient groups and periods; they do not predict or guarantee your personal outcome. Patient testimonials reflect individual experiences.
Treatment does not guarantee fertilisation, embryo development, pregnancy or live birth. Any financial refund commitment under our IVF Guarantee Program is explained separately in section 7 and the applicable programme agreement.
4. Enquiries, information sessions and appointments
Submitting an enquiry or appointment request does not confirm a booking. An appointment is confirmed when HOPE communicates its acceptance and the appointment details to you. An automated acknowledgement confirms receipt only.
Where advertised, an initial information session is free of charge. This does not mean that a medical consultation, diagnostic test or treatment is free. Any applicable fee will be explained before you book the relevant service.
Appointment dates and treatment schedules depend on clinical requirements and availability. If an appointment needs to change, we will contact you as soon as reasonably possible to discuss suitable arrangements.
5. Prices and payment
Website prices and package descriptions should be read with their stated inclusions, exclusions and conditions. Before you commit to a paid service, we will provide the applicable price or quotation and explain the payment arrangements.
Your quotation or service agreement will identify the services included, any agreed additional charges, applicable taxes where relevant, and the payment schedule. Please ask us if anything is unclear before accepting.
Additional investigations or changes to treatment may affect the total cost. We will explain proposed additional charges and obtain your agreement before providing additional chargeable services, except where urgent care must be provided in accordance with applicable law.
Updates to website prices do not retrospectively change an agreed price. Any variation to an existing agreement must be handled under that agreement and applicable law.
Public funding, insurance reimbursement and third-party financing are subject to the relevant provider's approval and conditions. HOPE does not guarantee approval. Any service you are asked to fund privately will be explained and agreed in advance.
6. Cancellations, postponements and refunds
Please contact us as soon as possible if you need to cancel or postpone an appointment or treatment.
Any cancellation deadline, missed-appointment fee, deposit condition or refund arrangement must be disclosed before booking or payment and included in the applicable booking or treatment terms. These website terms do not introduce a blanket non-refundable payment rule.
If treatment is cancelled or stopped, the financial position will be assessed under the agreed terms and applicable law, taking account of services already provided and properly disclosed costs already incurred. We will explain any deductions and any refund due.
If HOPE cannot provide an agreed service, we will discuss alternatives with you or refund amounts due for services not provided, subject to applicable law and the relevant agreement. This does not limit any further rights or remedies you may have.
An unsuccessful treatment outcome does not by itself establish a right to a refund. This does not affect the IVF Guarantee Program, an express refund commitment or any statutory remedy.
7. IVF Guarantee Program
Our IVF Guarantee Program is available only to patients who meet its eligibility criteria and enter into the applicable programme agreement.
The programme offers multiple agreed treatment attempts for a fixed programme fee and a full refund of that fee if the agreed pregnancy outcome is not achieved by the end of the agreed cycles, subject to the programme's clearly disclosed conditions.
The current website description defines the pregnancy outcome as a fetal heartbeat visualised on an ultrasound scan. This is different from a live birth. The programme agreement must clearly explain the outcome definition, number of attempts, included services, eligibility conditions, completion requirements and refund process before enrolment.
The programme is a financial commitment subject to those terms; it is not a medical assurance that pregnancy or live birth will occur. These general website terms do not reduce an agreed programme refund entitlement.
8. Cryopreservation and storage
Storage of eggs, sperm or embryos requires separate consent and a storage agreement. That agreement will explain the applicable charges, storage period, renewal arrangements and the procedures governing use, transfer or other lawful decisions concerning stored material.
Please keep your contact information current so that we can communicate with you about storage and consent requirements. Decisions concerning stored biological material are governed by the relevant consents, agreements and applicable law. These website terms do not authorise disposal or transfer of biological material.
9. Privacy and communications
We process personal data as explained in our Privacy Policy and applicable patient privacy notices.
Please use the channels advised by our team when sending medical records or sensitive documents. Do not submit another person's information unless you are authorised to do so.
Submitting an enquiry does not constitute consent to medical treatment or optional marketing. Where consent is required, it will be requested separately.
10. Permitted use and website content
You may use the website for lawful purposes and view, download or print content for personal, non-commercial use. Please retain any copyright notices and do not present general information as personalised medical advice.
Content, branding and other materials belong to HOPE or their respective rights holders. Reproduction, modification or commercial reuse requires permission unless permitted by law.
You must not submit fraudulent information, introduce malicious software, attempt unauthorised access or interfere with website security or availability. We may restrict access where reasonably necessary to address misuse or protect users and systems.
11. External providers and website availability
Links to external websites are provided for convenience. External providers have their own terms and privacy policies. Unless expressly agreed otherwise, arrangements with banks, travel providers, accommodation providers or other independent businesses are made directly with those providers.
We aim to maintain website availability, but access may be interrupted by maintenance, technical issues or circumstances beyond our reasonable control. Contact the clinic directly if an online service is unavailable or you need confirmation of an appointment or message.
12. Responsibility and your rights
Nothing in these terms excludes or restricts liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or restricted.
These terms do not waive your patient rights, consumer rights, data protection rights or legal remedies. Our responsibilities in providing healthcare remain governed by applicable law, professional duties and the relevant treatment agreement.

14. Applicable law and updates
These terms are governed by Maltese law, without depriving you of mandatory protections that apply under another relevant law. Any dispute will be dealt with by the courts competent under applicable jurisdiction rules.
We may update these terms and will show the revised date on this page. Updates apply prospectively and do not retrospectively change an existing treatment agreement, agreed price or refund entitlement. Any change requiring your agreement will be addressed separately.
